Texas sues nursing home after allegations of negligence

At some point, families of aging loved ones must eventually confront the question of whether or not to place a senior in a nursing home. When someone reaches the point when he or she can no longer care for himself or herself, most families will carefully consider assisted living facilities and nursing homes as possible options. Whatever facility they decide to go with, it is almost always one that they believe they can trust to offer their loved ones proper, thorough care.

Upholding standards of patient care is a critically important responsibility of any Texas nursing home, but sometimes nursing negligence occurs and can leave a resident injured, sometimes even fatally so. Recently in Texas, the state decided to move forward with a lawsuit against an Arlington nursing home. The suit has been brought forth in light of accusations that the facility did not provide proper care to its vulnerable residents.

In the spring of 2013, the Department of Aging and Disability Services investigated the facility after it had come across complaints regarding pressure sores on patients. Also known as bed sores, pressure sores are sensitive areas of damaged skin that often result from a person's sitting or lying in one position for long periods of time. Pressure sores can lead to infection, sometimes serious ones that can cause further complications. Failure to treat infected pressure sores can have deadly consequences for the afflicted person.

The lawsuit alleges that the facility did not live up to standards of minimum care, nor did it adhere to codes of patient health and safety. In addition, claims the suit, the facility did not properly maintain medical records. The suit is seeking a maximum of $20,000 for each alleged violation. Moreover, the state is also pursuing an injunction against the company which runs the facility.

Nursing negligence and doctor errors can be devastating for victims and their families. Holding individuals and facilities accountable for such negligence may seem overwhelming to victims and their families, but in most cases the state will refrain from filing a suit unless many individuals have been affected. Civil suits brought forth by victims and their family members can be just as effective in making sure negligent entities are held responsible.
